botched plastic surgery

We have a new case where a plastic surgeon botched a breast lift and tummy tuck. The medical facility is in the Dutchess County and Albany, NY area. The pictures show open wounds and scars that are hard to believe a surgeon would be able to do this to a person. The person asked for a size C and was given a double dd. The tummy tuck scar is visible and in no way looks like a plastic surgeon did it. When the client told the surgeon she was unhappy with the result the surgeon said "ok, I can fix it but in my office with local anesthesia" and performed surgery in an office. Now the person has open wounds that won't heal. No Dr. in the area will see her because of the obvious malpractice. Has anyone ever heard of a case like this?

  1. I am an attorney and have a situation -- not a case -- with the same facts of dd v. c and terrible stomach scars. Different doc on LI (he's also a functional drunk). No open wounds though. He made "repairs" which made the scars worse. Two problems: women are not not rational about this (prior to surgery); and, when I investigated the scaring, there is wide latitude about it. The docs lie all the time about what they promised in terms of size and also use a sneaky technique by pulling on the prosthetic bra to influence the women to pick a cc unit instead of a size.

Yes, I have very often heard about this type of medical negligence cases which occurs when a medical professional makes a mistake or fails to exercise an accepted degree of skill which results in an injury or death. A study conducted in 1990 by the Harvard School of Medicine estimated that some 3% of patients treated in New York State Hospitals suffered as a result of some kind of medical mistake which resulted in a serous injury.
